Welcome to Nitty Online English School, an online English school in Japan dedicated to providing high-quality English language learning services tailored to the needs of Japanese learners. These Terms and Conditions ("Terms") govern the use of Nitty Online English School services ("Services") provided by Nitty Online English School ("Company"). By using our Services, you agree to these Terms. Please read them carefully before using our platform.

Article 1: General Information

• 1.3. Language of Terms: These Terms are provided in English and Japanese. In the event of any conflict or discrepancy, the Japanese version shall prevail.
• 1.4. Definitions:
  • i.ユーザー: Any individual or entity that uses the Services.
  • ii.Minor: An individual under the age of 18, as defined by Japanese law.
  • iii.Registration Information: Personal information provided by the User, including name, email address, phone number, and payment details.
  • iv.Service Provider: Instructors or staff employed or contracted by the Company.
• 1.5. Jurisdiction: These Terms and Conditions are governed by the laws of Japan, including but not limited to the Act on Specified Commercial Transactions, Act on the Protection of Personal Information (APPI), and Consumer Contract Act.
• 1.6. Scope of the Terms: These Terms apply to all activities performed by Users while using the Services. Any specific terms or additional conditions provided by the Company shall be considered part of these Terms.

Article 2: Eligibility

• 2.1. Age Requirements: You must be at least 18 years old to create an account and use our services independently. Minors under 18 years old may register only with the explicit consent of a parent or legal guardian. Parents or guardians are responsible for monitoring the minor's use of the Services.
• 2.2. Residency: Our services are primarily designed for residents of Japan. Non-residents may access our services but must comply with Japanese laws and time zones.
• 2.3. Prohibited Users: We reserve the right to deny services to individuals who have previously violated these Terms, engaged in fraudulent activities, or posed a threat to the community.

Article 3: Registration and Accounts

• 3.1. Account Creation: To use our services, you must register by providing accurate and complete personal information, including your full name, email address, and payment details. False or misleading information may result in account suspension or termination.
• 3.2. Account Security: You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately if you suspect unauthorized access to your account.
• 3.3.Account Termination: To delete an account, Users must contact the Company's support team. We may terminate your account if you violate these Terms or engage in disruptive or abusive behavior.

Article 4: Services

• 4.1. Course Offerings: We provide a variety of courses, including:
  • i. Daily Conversational English
  • ii. Business English
  • iii. Travel English
  • iv. Grammar
  • v. Hobby English
  • vi. Young Learners English
• 4.2. Lesson Format: Lessons are conducted online via platforms such as Zoom. Recorded lessons are not provided unless explicitly stated.
• 4.3. Customization: Students may request customized lessons to meet their specific goals, such as preparing for exams (e.g., TOEIC, IELTS).
• 4.4. Limitations: We do not guarantee specific outcomes or results, as progress depends on individual effort and practice.

Article 5: Payment and Pricing

• 5.1. Fees: Course fees are displayed on the Company's website and include applicable consumption tax.
• 5.2. Payment Methods: Accepted payment methods include credit cards, PayPal, and bank transfers. Additional options may be added at our discretion.
• 5.3. Billing Cycle: Payments for courses must be made in advance. Subscriptions or packages will be charged on a monthly or one-time basis, depending on the payment plan selected.
• 5.4. Currency: All payments are processed in Japanese Yen (JPY). Any currency conversion fees are the responsibility of the student.
• 5.5. Refunds: Refund requests must be made in writing via email to customerservice@nittyenglish.com. Refunds are processed within 14 business days and may be subject to a processing fee.

Article 6: Cancellation and Refunds

• 6.1. Cancellation of Lessons:
  • i. Lessons canceled at least 24 hours before start time will not incur a charge.
  • ii. Cancellations within 24 hours of the scheduled time will be marked as “no-show” and will not be refunded or rescheduled.
  • iii. Cancellations made at least 24 hours before the lesson are eligible for rescheduling or rebooking at the user's convenience.
• 6.2. Termination of Services: Students may terminate their subscription at any time by providing written notice. Refunds for unused lessons in prepaid packages will be processed per our refund policy.
• 6.3. Force Majeure: We are not liable for cancellations due to events beyond our control, such as natural disasters, technical failures, or government restrictions.

Article 7: Student Responsibilities

• 7.1. Punctuality: Students must join lessons on time. Late arrivals may result in a reduced lesson duration.
• 7.2. Code of Conduct: Students must interact respectfully with teachers and other students. Any behavior deemed inappropriate may result in immediate termination of services without refund.
• 7.3. Prohibited Actions:
  • i. Harassment of any nature, including but not limited to power, sexual, racial, or other forms of harassment.
  • ii. Disruptive behavior toward other Users or instructors.
  • iii. Unauthorized access, data tampering, security breaches, or malicious use of our platform.
  • iv. Reselling or commercial use of the Services without prior consent.
  • v. Any action that contradicts these Terms of Use.
• 7.4. Technical Requirements: Students are responsible for ensuring a stable internet connection and functional devices.

Article 8: Teacher Responsibilities

• 8.1. Professional Standards: Teachers are trained to provide high-quality, engaging lessons tailored to student needs. They will provide constructive feedback and assign relevant practice exercises.
• 8.2. Availability: Teachers will make reasonable efforts to accommodate scheduling preferences.
• 8.3. Cancellations by Teachers: In rare cases where a teacher must cancel a lesson, students will be offered a free reschedule or refund.

Article 9: Learning Resources

• 9.1. Access: Students enrolled in specific courses will receive access to relevant learning materials, including PDFs, slides, and/or worksheets.
• 9.2. Restrictions: Learning resources are for personal use only and may not be copied, distributed, or sold.

Article 10: Privacy Policy

• 10.1. Data Collection: We collect personal information to provide our services, process payments, and communicate effectively.
• 10.2. Data Usage: Personal data will not be shared with third parties without explicit consent unless required by law. We adhere to the Act on the Protection of Personal Information (APPI) in Japan.
• 10.3. Data Security: We use industry-standard encryption and secure servers to protect user data.
• 10.4. Access to Data: Students may request access to their personal data or request deletion by contacting [Support Email].

Article 11: Intellectual Property

• 11.1. All content, materials, and branding used in our courses are owned by Nitty Online English School.
• 11.2. Unauthorized reproduction, distribution, or commercial use of materials will result in legal action.

Article 12: Dispute Resolution

• 12.1. Initial Resolution: Disputes should first be addressed informally by contacting support@nittyenglish.com.
• 12.2. Arbitration: Unresolved disputes will be referred to arbitration in Japan, conducted in accordance with Japanese law.
• 12.3. Jurisdiction: All legal proceedings shall be held in the courts of Osaka, Japan.

Article 13: Limitation of Liability

The Company is not liable for:

• i. Interruptions, delays, or errors in the Services.
• ii. Unauthorized use of a User's account.
• iii. Issues arising from incorrect information provided by the User.

The Company's liability shall not exceed the amount paid by the User for the Services.
